RIVERSIDE COUNTY, California ?? A 120-pound bull mastiff dog escaped from its yard and attacked a 6-year-old boy and his mother Maria Juarez as they walked past the dog?s home? in a Moreno Valley residential neighborhood, according to police reports.
The dog first attacked Juarez?s son Ruben mauling his head and ripping off part of his ear. The mother, who was pushing a younger sibling in a stroller, was also bitten on her hip after she intervened in an attempt to stop the dog from attacking her son. The younger child in the stroller was not harmed in the dog attack.
Both the mother and son were taken to a local hospital with non-life threatening injuries. Doctors were able to re-attach the boy?s ear
The Jan. 24 dog bite incident took place just before noon on Indian ?Avenue near Sunnymead Boulevard. The owner of the dog came to help the family and put the dog back into its yard prior to the arrival of police. The dog owner was not cited for the incident.
The dog owner handed over the dog to Moreno Valley animal control officials who placed it under quarantine, but the 18-month-old animal is most likely going to be euthanized due to the unprovoked attack.
Under California Civil Code Section 3342, the dog owner in this situation may be held accountable for the actions of the dog: ?The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner?s knowledge of such viciousness.?
